Criminal/Drug Free Policy
The Board of Directors of Stratford Townhouses Cooperative has determined that it is in the best interest of the Cooperative corporation to maintain a criminal free and a drug free environment in the Cooperative. Therefore, the Board of Directors has adopted the following policy statement which is given immediate effect upon its publication and distribution to the members.
1. The Members of Stratford Townhouses Cooperative understand that they will not personally engage in, nor allow any household member, guest, visitor or friend to engage in any unlawful activities in their home or anywhere on Stratford Townhouses Cooperative property.
2. Unlawful activities incude, but are not limited to acts of violence that damage or destroy the dwelling unit or disturb or injure other members or anyone else inside or outside of the dwelling unit or anywhere else on Cooperative property.
3. The Members of Stratford Townhouses Cooperative understand that they will not personally engage in, nor allow any household member, guest, visitor or friend to engage in any act intended to facilitate criminal activities including drug related criminal activities and acts of violence or threats of violence, including, but not limited to the unlawful discharge of firearms or use of weapons on or off Cooperative property.
4. Drug Related Criminal Activities means the illegal manufacture, sale, distribution, use, holding, or keeping of a controlled substance (as defined in Section 102 of the Controlled Substance Act (21 U.S.C.802)).
5. The Members of Stratford Townhouses Cooperative understand that they will not engage in, nor allow any household member, guest, visitor or friend to engage in any unlawful activitity, including drug related criminal activitity, inside or outside of townhouse or anywhere on Cooperative property.
6. Any violation of the above provisions shall be deemed a material violation of the Occupancy Agreement and will be substantive good cause for termination of the Membership and Occupancy Agreement. It is understood and agreed that a single violation and a material non-compliance with the Occupancy Agreement are legal and justifiable cause for termination of the Membership and Occupancy Agreement.
7. Proof of violation shall not require criminal conviction, but shall be by a preponderance of the evidence.
8. This policy shall be treated as if it were an addendum to the Occupancy Agreement.
