Vehicle and Parking Lot Policy

1. Definitions.

    a. Vehicle: Any motorized device used for transportation of people and/or materials.

    b. Recreation Vehicle: A vehicle used primarily for the purpose of recreation or that provides recreation. (Examples are house trailers, camper trailers, motor homes, snow-mobiles, all terrain vehicles, and cargo trailers utilized to haul vehicles.)

    c. Resident: Any member or non-member occupying a unit of the Cooperative.

    d. Minor Repairs: Minor Repairs are those repairs which do not take longer than one (1) hour to complete, else they shall be Major Repairs.

    e. Major Repairs: All repairs not falling within the defined category of Minor Repairs.

2. Parking of Resident and/or Guest Vehicle:

    a. Residents will be issued identifying stickers for the left rear bumper or lower left corner of the rear windsheild of each of their vehicles. A record will be maintained of vehicle stickers issued to each resident by the office and/or by the appropriate Board-appointed committee. All residents are required to have a sticker displayed on each vehicle owner, including two-wheeled vehicles. Members are also required to re-register their vehicle whenever new license plate numbers are issued to a registered vehicle. Identifying stickers are not transferable.

    b. Each townhouse dwelling unit will be assigned one (1) parking space. That space will be numbered to correspond with the unit address number. This numbered space shall be reserved for the sole use of the resident(s) of that unit and is not to be used by anyone else without prior permission. Residents will use their numbered parking space primarily, and not use non-numbered spaces in order to leave numbered spaces available. (i.e., Residents cannot leave their numbered (primary) space vacant while they or their guests have a vehicle parked in an unnumbered space. Note: This does not apply to residents whose numbered (primary) space is designated as handicap parking.)

    c. All non-numbered parking spaces will be available for parking on a first come, first served bases, for residents and guests alike. However, residents shall not be permitted to use more than one non-numbered space at any one time, whether for themselves or for guests. No resident will consider a non-numbered space as being for his/her use only. Families with more than two vehicles will park the remaining vehicles out of the parking lots.

    Persons who own two wheeled, motorized vehicles (motorcycles, motorbikes, mopeds, etc.) may park such vehicles in a manner that is parallel to the parking lot curb facing and in their regular assigned, numbered parking space, in front of their regular car or pick-up, from March 16 through November 14 only. Two wheeled motorized vehicles may not occupy this space between November 15 and March 15. (See diagram attached to this policy for clarification, if necessary.)

    d. Vehicles shall not be permitted to park in the parking lot entrances, or anywhere in the parking lots other than in the lined spaces.

    e. A wood or metal plate will be placed under the kick stand of a parked two-wheeled motorized vehicle at all times to prevent damage to the parking lot surface.

    f. Two wheeled motorized vehicles shall be supported so as to prevent the possibility of falling over or being knocked over.

    g. At all times of the year, vehicles shall be parked back from the parking lot curb far enough (three (3) inches) so that the vehicle bumper (front or rear) does not overhang the curb at all.

    h. Under no circumstances will vehicles be permitted to be parked or driven on any grassed areas, sidewalks or patios. No vehicles will be permitted in any dwelling unit, disassembled or whole.

    i. Members (or their families or guests) who park in a parking space marked for handicapped parking without an appropriate permit may be subject to a charge of $50.00 by the Cooperative in addition to whatever fines or charges may be assessed by an appropriate agency of the City, County and or state police or court system(s).

    j. Damages to Parking Lots: The Member shall be liable for the staff-estimated cost of repair as liquidated damages for parking lot damage(s) caused by member or guest’s vehicle.

3. Repair of Vehicles

    a. No major repairs will be permitted in any Cooperative parking lots.

    b. Minor repairs may be done in a resident’s numbered parking space provided the following conditions are met:

      i. The vehicle must be resident-owned and display a Cooperative-supplied sticker.

      ii. During repair operations, and in case the vehicle is elevated, the vehicle must be firmly supported.

      iii. A responsible adult will be in attendance at all times while a vehicle is elevated to keep children out of danger.

      iv. No vehicle, including two-wheeled motorized vehicles, will be placed partially or completely on a parking lot curb, sidewalk or lawn at any time.

      v. Upon completion of any repair work, all dirt, oil, grease, unused parts, tools, etc. will be picked up or cleaned up immediately leaving no unsightly mess.

      vi. Care must be taken that gasoline or solvents of any kind are not spilled on the parking lot surface.

4. Undesirable Vehicles Are Defined As:

    a. Those vehicles that are not displaying current license plates.

    b. Those vehicles which in any way obstruct traffic, or obstruct the proper parking of another vehicle, or are improperly parked by parking on the drive way, parking behind another vehicle, or parking straddling or across marked parking space lines.

    c. Those vehicles that are incapable of moving under their own power, except as may be authorized by the appropriate committee.

    d. Those recreational vehicles parked on Cooperative property for more than twenty-four (24) hours in any given seven (7) day period unless authorized by the appropriate Board-appointed committee. Recreational vehicles may not be used as housing at any time.

    e. Those vehicles which are parked in a numbered space without the permission of the resident to whom the space is assigned.

    f. Those vehicles undergoing major repairs.

5. Complaint Procedures:

    a. Enforcement of this policy shall be delegated to a Board-appointed Committee and Cooperative staff persons, although it is expected that staff will refer all matters to Committee persons unless immediate action is required and Committee persons are not available. Staff persons are specifically delegated authority to enforce Section 2.g. without referral to Committee persons.

    b. Complaints may originate with Cooperative members, Cooperative staff persons, or persons serving on the Board-appointed committee with the responsibility of enforcing this Policy. All persons originating complaints and/or action to enforce parts of this policy must present them in writing, although complaints requiring immediate action made by committee persons or staff persons may be filed after enforcement action is taken. Copies of all complaints shall be maintained by the Cooperative office and by the Committee.

    c. Complaints may be delivered to the Cooperative office and/or to any person known to be serving on the Board appointed committee responsible for enforcement of this Policy. If a complaint is delivered to a committee person, that committee person is charged with the responsibility of filing prompt and proper reports with the full committee and the Cooperative office, including the complaint and subsequent enforcement action(s) taken.

6. Non-members of the Cooperative: It shall be the duty of each member of the cooperative to inform his (her) family, relatives, guests and other visitors of the provisions of this Policy, and each member shall be held responsible for the actions of any visitor who violates this Policy. Any penalties imposed under this Policy shall be imposed against a member in all cases, as though (s)he were the proper owner of an offending vehicle.

7. Penalties: Penalties authorized by the Board of Directors shall ball into the following categories:

    a. Penalties for violation of this Policy in which immediate action of enforcement is necessary because of danger to persons, real or personal property, or to enforce assigned parking space regulations shall be as follows:

      i. Members of the Cooperative who are found by a committee member to violate a provision of the policy falling within this category (including actions by friends, relatives, guests, and/or other visitors of members) shall be assessed a charge of twenty-five dollars ($25.00) or the amount specified in the text body.

      (Sections of this policy which fall in this category are: 2.b.; 2.d.; 2.f.; 2.h.; 2.i., 3.a.; 3.b.ii.; 3.b.iii.; 4.b.; 4.e.; and 4.f.)

    b. Penalties for violations of this Policy in which immediate action of enforcement is not necessary shall be as follows:

      i. Members of the Cooperative who are found by a committee member to violate a provision of the policy falling within this category (including actions by friends, relatives, guests, and/or other visitors of members) shall be assessed a charge of ten dollars ($10.00).

      ii. Further or continued violation by a member who has been previously notified of a violation shall result in a charge of fifteen dollars ($15.00).

      iii. Failure of a member to correct a violation shall result in a charge of twenty-five dollars ($25.00).

      (Sections of this policy which fall in this category are: 2.a.; 2.c.; 2.e.; 3.b.i.; 3.b.iv.; 3.b.v.; 3.b.vi.; 4.a.; 4.c.; and 4.d.)

    c. The penalty for violation of Section 2.g. of this Policy (parking so as to overhang the parking lot curb) shall result in a charge of ten dollars ($10.00).

    d. Damages to Parking Lots. The Member shall be liable for the staff-estimated cost of repair as liquidated damages for parking lot damage(s) caused by a member of guest’s vehicle.

    e. Persistent violation of this policy (whether of the same section or differing sections) by any member shall be considered to be a violation of the terms and conditions of an Occupancy Agreement signed between a member and the Cooperative, and shall be considered to be a default of that Agreement by the Board of Directors of the Cooperative

8. Exceptions: Exceptions to any of the provisions of this Policy, its categories, rules, sections and/or penalties may be granted by the Board of Directors upon written notice to the Board of Directors by the owner of a vehicle prior to the penalty stage of any offense. The Board of Directors shall require good and sufficient evidence to grant exceptions(s).

9. General Exception and Clarification: (See Vehicle and Parking Lot Policy, Section 2.c. (2nd paragraph)

    a. The parking to two-wheeled motorized vehicles in the manner described, together with a car in the second space (which may be construed as three (3) vehicles parked in the lot) shall not violate the intent of this Policy. The intent of Section 2.c. is that not more than two parking spaces shall be occupied by any member-family.

    b. HOWEVER, two wheeled motorized vehicles must be parked in the manner indicated above (and in the diagram below) to meet the conditions of this General Exception.
